1. Acceptance of Terms

By accessing or using the FaceCheckNow website located at facechecknow.com (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you (“User,” “you,” or “your”) and FaceCheckNow (“we,” “us,” or “our”). We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Service. Your continued use of the Service following any changes constitutes acceptance of those changes.

2. Description of Service

FaceCheckNow provides an AI-powered reverse face search service that allows users to upload a photograph containing a human face and search for publicly available instances of that face across the internet. The Service uses facial recognition technology to generate mathematical vector representations (embeddings) of uploaded faces and compares them against publicly available images indexed from the open web.

The Service is designed for personal, non-commercial use cases including but not limited to: verifying the identity of individuals encountered on online dating platforms, confirming the authenticity of social media profiles, and general identity verification purposes.

FaceCheckNow does not guarantee the accuracy, completeness, or reliability of search results. Results are derived from publicly available information and should not be used as the sole basis for any decision affecting an individual's rights, employment, credit, insurance, housing, or any other purpose governed by applicable law.

3. User Accounts

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

We reserve the right to suspend or terminate your account at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. Any unused credits or prepaid amounts are non-refundable upon termination for cause, including violations of these Terms.

4. Acceptable Use

You agree that you will not use the Service to:

  • Stalk, harass, threaten, intimidate, or otherwise cause harm to any individual.
  • Make employment decisions, tenant screening decisions, credit decisions, insurance underwriting decisions, or any other decisions subject to the Fair Credit Reporting Act (FCRA) or similar legislation.
  • Engage in any activity that violates applicable local, state, national, or international law or regulation.
  • Upload images of minors (individuals under 18 years of age) for any purpose.
  • Upload images that you do not have the right to use or that infringe upon the intellectual property rights of any third party.
  • Attempt to reverse-engineer, decompile, disassemble, or otherwise derive the source code or underlying algorithms of the Service.
  • Use automated means, including bots, scrapers, or crawlers, to access the Service without our prior written consent.
  • Resell, redistribute, or sublicense access to the Service or any results obtained through the Service without prior written authorization.
  • Use the Service in any manner that could damage, disable, overburden, or impair any of our servers or networks.

We reserve the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates this provision, including removing offending content, suspending or terminating the account of such violators, and reporting them to law enforcement authorities.

5. FCRA Compliance Notice

FaceCheckNow is NOT a consumer reporting agency as defined by the Fair Credit Reporting Act (15 U.S.C. § 1681 et seq.) (“FCRA”), and the information available through the Service does not constitute a “consumer report” as defined by the FCRA.

You acknowledge and agree that you shall not use the Service, or any information obtained through the Service, for any purpose covered by the FCRA, including but not limited to:

  • Evaluating a consumer for credit, insurance, employment, or any other purpose authorized under the FCRA.
  • Determining a consumer's eligibility for a license or other benefit granted by a governmental instrumentality.
  • Any other purpose for which a consumer report may be used under the FCRA or any comparable state statute.

You further represent and warrant that you will not use any information obtained from the Service to take any “adverse action” as defined by the FCRA against any individual. Violation of this provision constitutes a material breach of these Terms and may subject you to legal liability under applicable law.

6. Credits and Payments

The Service operates on a credit-based system. Credits may be purchased through various payment methods as offered on the Service. All purchases of credits are final and non-refundable, except as required by applicable law or as expressly stated in our refund policy.

Subscription plans automatically renew at the end of each billing cycle unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings, and cancellation will take effect at the end of the current billing period.

We reserve the right to change our pricing, credit packages, and subscription plans at any time. Changes to pricing will not affect credits already purchased but may apply to future purchases and subscription renewals.

7. Intellectual Property

The Service, including its original content, features, functionality, and underlying technology, is and will remain the exclusive property of FaceCheckNow and its licensors. The Service is protected by copyright, trademark, and other laws of the United States and foreign jurisdictions.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent. Nothing in these Terms grants you any right to use any of our trademarks, logos, domain names, or other distinctive brand features.

By uploading images to the Service, you grant us a limited, non-exclusive, royalty-free license to process the image solely for the purpose of providing the Service to you. This license terminates when the image is deleted from our systems, which occurs automatically within 24 hours of upload as described in our Privacy Policy.

8. Disclaimers

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

FACECHECKNOW DOES NOT WARRANT THAT (A) THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (B) ANY ERRORS OR DEFECTS WILL BE CORRECTED; (C) THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (D) THE RESULTS OF USING THE SERVICE WILL BE ACCURATE, COMPLETE, OR RELIABLE.

Search results are generated from publicly available information indexed from the open web. We do not verify the accuracy of source data and cannot guarantee that search results correctly identify any individual. False positives and false negatives may occur.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FACECHECKNOW, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) ANY CONTENT OBTAINED FROM THE SERVICE; AND (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

10. Indemnification

You agree to defend, indemnify, and hold harmless FaceCheckNow, its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt and expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to the Service; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any intellectual property, privacy, or proprietary right; or (d) any claim that your use of the Service caused damage to a third party.

11. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may do so by contacting us at support@facechecknow.com or through your account settings.

All provisions of these Terms that by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

12. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may submit the dispute to binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in the English language.

Notwithstanding the foregoing, either party may seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property rights or confidential information.

13. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
